1977 ford escort 2.0 cosworth turbo,




330 bhp,320 lbft torque(set up by power engineering),3-bar map sensor,rs500 intercooler t35 hybrid turbo, grey injectors,group A headgasket,variable boost controller,bailey dump valve and more!,wilwood 4 pots(front),cosworth sierra brakes(rear).cosworth 5-speed and rear axle,diff and independant rear suspension, 16" tsw wheels, rs2000 nose and x-pack,finished in black, e/w, clifford imobiliser.taxed & 1 yrs mot, full cage, harnesses, sierra cosworth clocks, must be seen,runs mid 12's 0-60 in approx 4.4 secs.forced sale-£4750 ono, may p/x, numbers edited by request. s.e.London/kent border.

I plan on doing a few track days and getting down the strip at Santa Pod and maybe North Weald.

Engine is now fully rebuilt and the fun can now begin. I have had a full engineers report done on the old engine and its looking like I have a good case for a small claims court claim.

On what basis can the claim be made? Unless it's from a dealer then its bought at buyers risk.

Of course if the car isn't as it is portrayed to be (e.g. Cav SRi's used to be badged up and sold as GSi's) when sold then there is definitely a case.
I'm not trying to put a dampner on anything, and I don't know any of the facts (other than the engine blew up), I'm just interested as it might help protect people in the future.

This subject was chatted about a little while ago I think?!? As I recall there is now some Law/ruling/standard that has been passed so that you can go back to a private seller?

I'm sure someone else will clarifiy.

What if the engineers report proves that the engine had been bodged just to sell?? Would that not prove that the good were sold by false pretence? I dunno? Just a thought!

I got screwed over a couple of years ago when I bought an xr4x4. It came with 12months MOT - the next day I realised it wasn't well - pads & discs were shot, so was a cv joint & gaiter.

I got the department of transport down as I was furious. The cae cost me £1000 and then cost me £900 to have all the bits put right.

The guy from the DOT inspected it with the bloke who had done the MOT (obviously a friend of a friend job). When it came to the crunch, the DOT guy said there was nothing he could do to prove that it was in this condition when the test was don, although he was 99% sure it was. I commented that the only thing that could possibly make it 100% had to be a signed confession!

The garage got put onto the DOT hit list, which means that they will get randomly tested (un-anounced) during the next 12 months.
I said "What, with a car that is a known failure - to see if they spot it?"
"oh no" was the response - "That'd be entrapment - the car will be 100% fully road legal. We will just watch them to make sure they check" http://www.turbosport.co.uk/images/smilies/crazy.gif http://www.turbosport.co.uk/images/smilies/crazy.gif

Basically, from my experience I now realise that an MOT might as well be a sheet of Andrex's finest for all it is worth, although Andrex is slightly more absorbent. http://www.turbosport.co.uk/images/smilies/laugh.gif

i thought it was a case of sold as seen......... and you as the buyer take the risk ???
if the eingine was that knackered surely this would be noticed before the purchase, what was the cause of the engine failure Lee?

If you buy privately, there is no legal protection as to the quality of the vehicle. It is up to you to satisfy yourself as to a vehicle's condition and history. This means asking the right questions and inspecting before you buy.

Legal rights of redress are limited, and unscrupulous dealers often masquerade as private sellers, so beware.

The only terms which the law implies automatically into a private sale contract are :

The seller should be entitled to sell the car.

The vehicle should not be misrepresented, and should correspond with any description applied. If the ad states that there is a valid MOT, there should be a valid MOT.

There is a good case as it was not sold as it was portrayed and only made it 9 miles(distance acorrding to seller)(Why did he measure??)from where it was sold. I have been told I should get back the full amout for the engine rebuilt including labour and also costs.

Just to add my crap words...We work on behalf of a lot of motoring clubs(aa, rac, g/f etc), and generally with private motors when they go bang after purchase,Ive never seen one "come back" yet.But i suppose there might be something all these folk are missing.And beleive me,i see a lot... http://www.turbosport.co.uk/images/smilies/confused.gif

I don't understand the law , but I have been advised that if a car is sold as a working car with no faults, it should do so for 14 days, If it fails before that and you can prove it was defective when buying(engineers report),and only doing nine miles. Then you have a case.

Ok the engine is sounding sweet now but the front supension set up is shite - hit a bump coming back from guildford and the wheel ripped in to the arche. So I have the front strip out and I am fitting compression struts and ajd tca to see if that sorts the front end out.
